The Process in California

The process generally involves several steps:

  1. Filing a Petition for Adoption – The step-parent begins by filing the necessary forms with the court.
  2. Consent or Termination of Parental Rights – The other biological parent must either consent to the adoption or meet legal criteria for their rights to be terminated.
  3. Investigation and Report – In most cases, a social worker or investigator reviews the family situation and prepares a report for the court.
  4. Final Hearing – The court reviews the petition and, once approved, finalizes the adoption, officially recognizing the step-parent as a legal parent.
